Terms of Service

These Terms of Service ("Terms") govern your access to and use of Yogalarm, including our mobile applications and related websites (the "Service"). By downloading, accessing, or using Yogalarm, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information and is incorporated by reference.

Yogalarm is an alarm and wellness application that may require you to complete yoga poses to dismiss alarms, track streaks and history, and optionally remind you to move during the day. Features may change over time as we improve the Service.

Yogalarm is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified professional before starting any exercise program, especially if you have health concerns. Use the Service at your own risk.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Yogalarm. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You may need an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

Yogalarm offers paid subscriptions on a monthly or yearly basis. Pricing, trial offers (if any), and included features are shown in the app or on the applicable app store listing at the time of purchase.

• Payments are charged to your Apple App Store or Google Play account when you confirm the purchase.
• Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
• You may cancel at any time. Cancellation stops future renewals; you typically retain access until the end of the current paid period. Refunds, if any, are handled according to Apple’s or Google’s policies.
• To manage or cancel a subscription, use your device’s subscription settings (Apple ID / Google Play subscriptions), not only the Yogalarm app.

We do not sell your personal information and do not use it for purposes unrelated to providing the Service, as described in our Privacy Policy.

If we offer a free trial, you may be charged when the trial ends unless you cancel beforehand through your app store account settings. Trial eligibility and length are determined at our discretion and may change.

You agree not to:

• Use the Service for any unlawful purpose;
• Attempt to reverse engineer, interfere with, or disrupt the Service;
• Circumvent subscription, security, or access controls (including alarm-dismissal requirements) in a way that violates these Terms;
• Misuse the Service in a way that could harm yourself or others during physical activity.

Yogalarm, including its name, branding, software, and content, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any ownership interest. You may use the Service only as permitted by these Terms.

The Service may rely on third-party platforms (such as Apple and Google) for distribution, payments, and authentication. Your use of those platforms is subject to their terms and policies. We are not responsible for third-party services we do not control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that alarms will always sound or function as expected on every device or OS version.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF GREATER, FIFTY U.S. DOLLARS).

Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply only to the fullest extent permitted.

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

You may stop using Yogalarm at any time and cancel your subscription as described above. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnity) will survive termination.

We may modify the Service or these Terms from time to time. We will update the effective date when we post changes. Material changes may also be communicated in the app or by email when appropriate. Continued use after changes become effective constitutes acceptance.

These Terms are governed by the laws of the jurisdiction in which the Yogalarm operator is established, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country require otherwise.
